A provision to require "internal and external" exams to verify a student's sex before playing K-12 sports in Ohio is expected to be scrapped on Tuesday.
Part of House Bill 151 is expected be revised by Senate Republicans to include a requirement that athletes whose sex is disputed "present a copy of the participant's original birth certificate," according to the amendment.
The bill, which passed through the Ohio House of Representatives in June, legislates a separation of teams for participants of each the male and female sex, with application "for co-ed teams for paticipants of the female and male sexes within co-ed sports divisions."
The latest version of the bill continues with the following on : "No school, interscholastic conference, or organization that regulates interscholastic athletics shall permit individuals of the male sex to participate on athletic teams or in athletic competitions designated only for participants of the female sex."
If an athlete's sex is disputed, "the participant shall establish the participant's sex by presenting a signed physician's statement indicating the participant's sex" based on "the participant's normal endogenously produced levels of testosterone," or "an analysis of the participant's genetic makeup," according to the bill.
The bill's current version would not allow transgender girls to play on female sports teams, but would not apply to colleges. An earlier version of the bill included public and private universities, but the language was stripped from the bill via an amendment.
The Ohio High School Athletic Association currently allows transgender boys and girls to compete on teams that align with their gender, providing they meet certain criteria, such as a year of hormone therapy.
The OHSAA has approved a total of 35 transgender male athletes and 11 transgender female athletes over the six years the policy has been in place.
